Chapter 6: The 1994 Clause

Arthur opened the binder with a reverence that matched its age. Inside, yellowed pages, legal script faded but still legible, lay preserved behind protective plastic sleeves.

He carefully turned a few pages, his finger tracing lines of text.

“Here it is,” he announced, his voice taking on a formal tone. “Article Seven, Section C: ‘Contingent Forfeiture and Asset Protection’.”

I leaned closer, my gaze fixed on the dense legal prose.

“It states,” Arthur read aloud, “that any attempt by a named heir to submit forged legal instruments, or to exercise unauthorized credit against the primary estate of the surviving spouse, shall be deemed a direct violation of fiduciary duty and a malicious act of fraud.”

His eyes met mine over the top of his glasses. The air in the room seemed to thicken.

“Upon such verified occurrence,” he continued, “all residual rights to the family land trust, including any and all associated properties, commercial ventures, and future inheritance, shall be immediately and irrevocably forfeited by the offending heir.”

The second part was even more critical.

“Furthermore, the entirety of said family land trust,” Arthur read, “including the principal residence of the surviving spouse and any related commercial real estate, shall automatically transfer into an irrevocable, sole-survivor lockbox, administered by the executor, with a federally recognized financial institution.”

This meant that not only would Chloe lose her claim to any future inheritance, but all the family properties, including my house and the land Chloe’s boutique sat on, would be placed under an untouchable legal lock.

“No one can touch it,” Arthur clarified, “except you, Evelyn, as the sole surviving principal beneficiary, and the bank as administrator. Not Chloe, not a creditor, not a future lawsuit.”

He pushed a single sheet of paper across the table, already signed by him as the designated executor. It was a formal verification document, confirming the activation of the clause based on Chloe’s actions and Julian Croft’s forged Power of Attorney.

“Just needs your signature, Evelyn,” he said, handing me a pen.

The weight of my husband’s foresight, his quiet strength even from beyond the grave, settled over me. I signed my name, a clear, decisive stroke, directly beneath Arthur’s.
